1. About These Terms

These Terms of Use (“Terms”) govern your access to and use of the DINAMICA website, platform, applications, features and related services (collectively, the “Service”).

DINAMICA is operated by 1013millibar Europe, a Swedish sole proprietorship (“DINAMICA”, “we”, “us” or “our”). References to “you” or “your” mean the individual accessing or using the Service.

By creating an account, accessing or using the Service, you agree to be bound by these Terms. If you do not agree to these Terms, you should not access or use the Service.

Your use of the Service is also subject to our Privacy Policy. Information concerning the nature, interpretation and limitations of financial, market, analyst and proprietary analytical information available through the Service is provided in the DINAMICA Disclosures. Additional terms or notices may apply to particular features, subscriptions, data sources or services where expressly identified.

These Terms form the agreement governing your use of the Service, together with any additional terms that are expressly incorporated into or made applicable under these Terms.

2. Eligibility and Account Registration

You must be at least 18 years old and have the legal capacity to enter into a binding agreement in order to create an account or use portions of the Service that require registration.

By creating an account, you represent that the information you provide during registration is accurate and that you will keep information that is material to the operation or security of your account reasonably up to date.

You are responsible for maintaining the confidentiality and security of your account credentials and for activities carried out through your account. You should use reasonable measures to protect your account from unauthorized access and notify DINAMICA promptly if you become aware of, or reasonably suspect, unauthorized use of your account or a compromise of your credentials.

DINAMICA accounts are intended for individual users only. Your account is personal to you and should not be shared with or transferred to another person except where expressly permitted by DINAMICA.

DINAMICA may offer different individual account types, subscription plans or access arrangements. Different features, usage limits or other conditions may apply to particular plans where expressly identified.

You are responsible for ensuring that your access to and use of the Service is permitted under laws and regulations applicable to you. DINAMICA may restrict account registration or access in jurisdictions, or for categories of users, where providing the Service would require legal, regulatory, licensing or other measures that DINAMICA has not implemented.

DINAMICA may require reasonable information or verification necessary to establish, maintain or secure an account, administer subscriptions, comply with applicable requirements or prevent misuse of the Service.

3. The DINAMICA Service

DINAMICA is a financial analysis and research platform that organizes financial, market and analyst information and produces proprietary analytical metrics and classifications.

The Service may provide access to financial and market information, company and security information, analyst recommendations and price targets, historical information, proprietary DINAMICA analytics, screening and comparison tools, portfolio monitoring functionality, alerts and other research, organizational or analytical features.

Certain features of the Service may allow you to select securities, create favorites or watchlists, maintain portfolio records, apply filters, sort or compare information, configure analytical thresholds or alerts, and otherwise personalize how information is organized or presented to you.

The features, data, analytical methodologies, coverage, functionality and presentation of the Service may evolve over time. DINAMICA may introduce, modify, replace or discontinue features or analytical functionality, subject to these Terms and applicable law.

Access to particular features, data or functionality may depend on your account type, subscription plan, geographic location, data availability, third-party licensing arrangements, technical requirements or applicable legal or regulatory restrictions.

Certain parts of the Service rely on information, infrastructure or services provided by third parties. The availability of particular data or functionality may therefore also depend on the continued availability and applicable terms of those third-party resources.

Descriptions of particular DINAMICA metrics, classifications and analytical methodologies, including their intended interpretation and limitations, are provided through the Service and in the DINAMICA Disclosures or related methodology materials. Those descriptions should be read together with these Terms when using the relevant analytical functionality.

DINAMICA may establish reasonable technical, usage or access limits necessary to operate the Service, maintain security and performance, comply with third-party rights or contractual restrictions, or apply the conditions of a particular account or subscription plan.

4. Financial Analysis and Research

The Service provides financial analysis and research functionality based on financial, market and third-party analyst information and on proprietary DINAMICA analytical methodologies.

DINAMICA may organize, normalize, aggregate, compare and process information obtained from third-party sources and use that information to calculate proprietary metrics, scores and classifications. DINAMICA analytical outputs are distinct from the underlying third-party information from which they may be derived.

Different DINAMICA analytical metrics and classifications are designed to evaluate different analytical dimensions. An output relating to one dimension should not be interpreted as an overall assessment of a security or as incorporating the conclusions of other DINAMICA analytical areas unless expressly stated otherwise.

Analyst recommendations, analyst price targets and other analyst information available through the Service originate from third-party sources. References to classifications such as STRONG BUY, BUY, HOLD, SELL or STRONG SELL in the context of Analyst Rating or analyst activity represent analyst-derived information and are not proprietary recommendations issued by DINAMICA.

DINAMICA may calculate proprietary metrics and classifications using analyst information, market prices, financial information or other available inputs. The processing or use of third-party information by DINAMICA does not mean that DINAMICA adopts or endorses any recommendation, estimate, price target, forecast or other opinion contained in the underlying information.

DINAMICA scores and classifications describe the result of the applicable analytical methodology using the information associated with the relevant analytical snapshot. Unless expressly defined otherwise, a score or classification does not represent a probability, expected investment return, guaranteed outcome or prediction that a particular future market event or price movement will occur.

DINAMICA analytical methodologies, data inputs, calculations, thresholds, classification ranges or other analytical components may be reviewed and modified over time. Such changes may affect analytical outputs and their comparability with outputs calculated under earlier methodology versions.

You are responsible for interpreting financial information and DINAMICA analytical outputs in light of their defined purpose, underlying data, timing and applicable limitations. Additional information concerning the meaning and limitations of DINAMICA analytics, analyst information and market data is provided in the DINAMICA Disclosures and applicable methodology materials.

5. No Personalized Investment Recommendations

DINAMICA company-level analytical metrics and classifications are designed to evaluate defined analytical dimensions of companies, securities, market context and analyst information. They are not calculated to determine whether a particular security or investment strategy is suitable or appropriate for an individual user.

DINAMICA does not use an individual user's financial situation, investment objectives, investment horizon, risk tolerance or other personal investment circumstances to modify its company-level analytical metrics or classifications or to determine which securities the user should buy, sell or hold.

Company-level DINAMICA analytics are also calculated independently of a user's portfolio holdings, transaction history, position size, acquisition cost or position performance. A security therefore retains the same company-level DINAMICA analytical metrics and classifications regardless of whether, or in what amount, a particular user owns that security.

The Service may allow you to personalize how you access, organize and monitor information. This may include selecting securities, creating favorites or watchlists, maintaining portfolio records, applying filters, sorting or comparing information, saving views, configuring analytical thresholds or creating alerts based on criteria selected by you.

Such user-defined selections, settings, thresholds and alerts apply criteria chosen by you to the information available through the Service. They do not represent a determination by DINAMICA that a security is suitable for you and do not convert the underlying company-level analytics into a personalized DINAMICA recommendation.

DINAMICA does not generate proprietary instructions directing you to buy, sell, hold, add to, reduce or exit a security based on your personal circumstances or portfolio. References to BUY or SELL within transaction functionality describe transactions entered or recorded by the user, while BUY, HOLD, SELL and related classifications displayed as analyst information represent third-party analyst views.

You remain responsible for determining how information, analytical outputs and user-configured functionality available through the Service relate to your own circumstances and for making your own investment decisions.

6. Third-Party Data and Information

Certain information available through the Service is obtained from third-party data providers or other external sources. Depending on the functionality used, this information may include market prices, company and security information, financial and fundamental data, analyst recommendations, analyst price targets, analyst actions and other financial, market or company-related information.

DINAMICA may organize, normalize, aggregate, compare, store and process third-party information for presentation through the Service or for use as an input to proprietary DINAMICA analytical methodologies. A proprietary DINAMICA metric or classification derived from third-party information is distinct from the underlying third-party data on which it is based.

Third-party information may be subject to differences in coverage, availability, methodology, reporting conventions, update frequency and timing. It may also be revised, corrected, withdrawn or otherwise changed by the relevant source or provider. As a result, particular information may not be available for every company, security or period, and information displayed through the Service may change following updates or corrections to the underlying data.

DINAMICA's ability to provide particular data, historical information or related functionality may depend on the continued availability of the relevant third-party source and on applicable licensing, distribution, attribution and use rights. DINAMICA may therefore modify, restrict, replace or discontinue access to particular third-party information or functionality where reasonably necessary as a result of changes in data availability, provider arrangements, third-party rights or applicable requirements.

Third-party recommendations, estimates, price targets, forecasts, opinions and similar information remain attributable to their underlying third-party sources. DINAMICA's inclusion, organization, processing or display of such information does not mean that DINAMICA adopts or endorses the underlying recommendation, estimate, forecast or opinion.

Third-party data and related content may be protected by intellectual property, database, contractual or other rights belonging to the relevant provider or other rights holder. Your right to access such information through the Service does not transfer ownership of that information to you and does not grant you any right to extract, redistribute, resell, publish or commercially exploit third-party data except where expressly permitted by DINAMICA, the applicable third-party terms or applicable law.

Specific attribution, notices, usage restrictions or additional terms relating to particular third-party data may be displayed within the Service or otherwise made available where required. You agree to comply with such restrictions to the extent they are applicable to your use of the Service.

Where required inputs are unavailable or insufficient for a particular DINAMICA methodology, the corresponding metric, classification or functionality may be unavailable. DINAMICA is not required to infer or substitute information that is not supported by the data available to the relevant methodology.

Additional information concerning the nature, timing and interpretation of third-party financial, market and analyst information is provided in the DINAMICA Disclosures.

7. Proprietary Analytics and Methodologies

DINAMICA develops and uses proprietary analytical methodologies to organize and analyze financial, market and third-party information and to calculate analytical metrics, scores and classifications made available through the Service.

DINAMICA's proprietary analytics may incorporate selected inputs, calculations, transformations, normalization methods, weighting, thresholds, classification ranges and other analytical components. Information describing a methodology may be provided through the Service, the DINAMICA Disclosures or related methodology materials to explain the purpose of the analysis, its principal inputs and the appropriate interpretation of its outputs.

DINAMICA is not required to disclose formulas, source code, weights, thresholds, transformations or other implementation details of its proprietary methodologies except to the extent disclosure is required by applicable law or is otherwise expressly provided by DINAMICA.

DINAMICA may review, develop and modify its analytical methodologies over time, including by changing inputs, calculations, weighting, normalization methods, thresholds, classification ranges or other analytical components. Methodology changes may affect analytical outputs and may result in differences between current and historical metrics or classifications.

Where historical analytical outputs were calculated using different methodology versions, those outputs may not be directly comparable. DINAMICA may preserve historical outputs as originally calculated or, where expressly identified, provide historical information recalculated under a later methodology. Additional information concerning methodology changes and historical interpretation is provided in the DINAMICA Disclosures.

Subject to third-party rights in underlying data and other materials, DINAMICA and its licensors retain their respective rights in the Service and in proprietary DINAMICA methodologies, software, analytical structures, documentation, presentation, terminology and other protected content made available through the Service.

Your access to the Service does not transfer ownership of DINAMICA's proprietary methodologies or other protected materials to you. Except to the extent permitted by applicable law or expressly authorized by DINAMICA, you may not reproduce, extract, systematically collect, reverse engineer, circumvent technical protections, or use the Service or proprietary DINAMICA materials for the purpose of reconstructing or creating an unauthorized substitute for DINAMICA's proprietary methodologies or Service.

Nothing in these Terms gives DINAMICA ownership of third-party information merely because that information is processed by a DINAMICA methodology. Rights in underlying third-party data remain subject to the rights of the applicable providers and other rights holders.

The availability of a DINAMICA metric, score or classification does not grant any right to use DINAMICA's proprietary methodology, branding or analytical framework independently of the Service except where expressly authorized by DINAMICA.

8. Portfolio and User-Provided Information

The Service may allow you to provide, enter, import or maintain information relating to securities, transactions, portfolio positions, favorites, watchlists, preferences, settings and other information associated with your use of DINAMICA (“User-Provided Information”).

You are responsible for the accuracy and completeness of User-Provided Information that you enter or otherwise provide to the Service. DINAMICA may process and use that information as reasonably necessary to provide, maintain and operate the functionality you request, including portfolio calculations, position monitoring, saved views, filters, alerts and related features.

Portfolio information displayed through the Service may be calculated from transactions, positions or other information recorded or provided by you together with relevant market data. The accuracy of portfolio calculations may therefore depend on the accuracy and completeness of the information recorded in your account and on the availability and timing of the applicable market data.

Unless expressly stated otherwise, DINAMICA does not independently verify that transactions or positions recorded in the Service correspond to transactions actually executed through a brokerage account or other financial institution. Portfolio records maintained in DINAMICA should not be treated as official brokerage, custody, tax or accounting records.

DINAMICA company-level analytical metrics and classifications are calculated independently of User-Provided Information relating to your portfolio, transactions, investment objectives, financial situation, investment horizon or risk tolerance. Adding, removing or modifying a portfolio position does not alter the corresponding company-level DINAMICA analytics.

DINAMICA may use User-Provided Information to determine which information or existing analytics to display, organize or monitor for you, including through portfolio views, favorites, filters, saved settings and alerts. Such use does not mean that DINAMICA has determined that a security, position or investment strategy is suitable or appropriate for you.

Transactions identified as BUY or SELL within portfolio functionality represent transaction types entered, imported or otherwise recorded by or on behalf of the user. They do not represent proprietary instructions or recommendations issued by DINAMICA.

You retain any rights you may have in User-Provided Information. You grant DINAMICA the rights necessary to host, store, process, reproduce and otherwise use User-Provided Information for the purpose of providing, securing, maintaining and improving the Service, subject to these Terms, the Privacy Policy and applicable law.

You must have the rights and authority necessary to provide any information that you submit to the Service and must not submit information in a manner that infringes the rights of another person or violates applicable law.

The collection, use, storage, retention and deletion of personal data associated with your account and use of the Service are further described in the DINAMICA Privacy Policy.

9. User Responsibilities

You are responsible for your use of the Service and for ensuring that your use complies with these Terms and with laws and regulations applicable to you.

You are responsible for evaluating the information and analytical outputs available through DINAMICA in light of their defined purpose, timing, underlying data and applicable limitations. Where information is material to a decision you intend to make, you should consider whether additional or more current information is appropriate for your purposes.

Any investment decision you make remains your responsibility. DINAMICA analytical metrics, classifications, screening tools, portfolio functionality, alerts and other research features are intended to form part of your own research process and do not replace your own evaluation of the circumstances relevant to a particular decision.

You are responsible for User-Provided Information that you enter, import or otherwise submit to the Service and for taking reasonable steps to ensure that information on which you rely for portfolio monitoring or other user-specific functionality is accurate and complete.

You are responsible for maintaining appropriate access to your account, protecting your credentials and promptly notifying DINAMICA if you become aware of unauthorized access or other circumstances that may compromise the security of your account.

You must use the Service in accordance with any reasonable technical, account, subscription or data-usage restrictions applicable to your access. You must also comply with any third-party data restrictions or notices that are expressly made applicable to your use of particular information through the Service.

You are responsible for any tax, accounting, regulatory or other obligations arising from transactions or investment activities undertaken by you. Portfolio records, calculations or other information available through DINAMICA are not official brokerage, custody, tax or accounting records.

You must not represent a DINAMICA proprietary metric, score or classification as a BUY, SELL, HOLD or other investment recommendation issued by DINAMICA, or otherwise materially misrepresent the nature or source of information obtained through the Service.

Nothing in this Section limits any responsibility that DINAMICA has under these Terms or any rights or remedies that cannot lawfully be excluded or limited under applicable law.

10. Acceptable Use

You may use the Service only in accordance with these Terms, the conditions applicable to your account or subscription, and applicable law.

You must not use the Service in a manner that interferes with its operation, security or availability or that materially impairs the ability of other users to access or use the Service.

Except where expressly permitted by DINAMICA or applicable law, you must not:

• access or attempt to access accounts, systems, data, functionality or areas of the Service for which you are not authorized;
• bypass, disable, circumvent or interfere with authentication, access controls, technical restrictions, rate limits, security measures or other protections applied to the Service;
• introduce malware, malicious code or other material intended to damage, disrupt, compromise or gain unauthorized access to the Service or related systems;
• probe, scan or test the vulnerability of the Service or related systems without authorization;
• use automated systems, bots, scripts, crawlers, scrapers or similar means to systematically access, collect, extract or copy information from the Service in a manner not expressly authorized by DINAMICA;
• systematically extract, reproduce, aggregate, redistribute, resell, publish or commercially exploit DINAMICA content, proprietary analytical outputs or third-party data except as expressly permitted by the Service, an applicable license or applicable law;
• reverse engineer, decompile, disassemble or otherwise attempt to reconstruct proprietary DINAMICA software or analytical methodologies except to the extent such activity cannot lawfully be restricted;
• use the Service or its outputs to create, train, develop or operate a product, database, dataset, model or service that reproduces or substitutes for a material part of DINAMICA's proprietary Service or analytical methodologies, except where expressly authorized by DINAMICA or permitted by applicable law;
• remove, obscure or materially alter copyright notices, trademarks, source attribution, data-provider attribution or other proprietary or legal notices displayed through the Service;
• use the Service to infringe intellectual property, privacy, confidentiality or other rights of another person;
• use the Service for fraudulent, deceptive or unlawful purposes, or to facilitate unauthorized access to or misuse of financial, personal or other protected information;
• falsely represent the source, meaning or nature of information obtained through DINAMICA, including by presenting a proprietary DINAMICA metric or classification as a BUY, SELL, HOLD or other investment recommendation issued by DINAMICA when it is not; or
• use another person's account without authorization or allow access to your individual account in violation of the conditions applicable to that account.

Where DINAMICA provides functionality specifically designed to export, download, integrate or access information programmatically, you may use that functionality within the technical, contractual, subscription and data-licensing limits applicable to it. The availability of an export, download or integration feature does not by itself grant rights to redistribute or commercially exploit third-party data or other protected content beyond those expressly provided.

DINAMICA may apply reasonable technical measures to detect, prevent or limit activity that violates this Section or threatens the security, integrity, performance or lawful operation of the Service. Any suspension or termination of access resulting from such activity will be subject to these Terms and applicable law.

Nothing in this Section prohibits activity that cannot lawfully be restricted under applicable law.

11. Intellectual Property

The Service, including its software, design, user interface, visual elements, documentation, proprietary content, analytical structures, methodologies, classifications, presentation and other materials developed or provided by DINAMICA, is protected by intellectual property and other applicable laws.

Subject to third-party rights and except as otherwise stated in these Terms, DINAMICA and its licensors retain their respective rights, title and interest in and to the Service and the intellectual property associated with it. These Terms do not transfer ownership of the Service or DINAMICA intellectual property to you.

Subject to your compliance with these Terms and any conditions applicable to your account or subscription, DINAMICA grants you a limited, non-exclusive, non-transferable and revocable right to access and use the Service for its intended purposes during the period in which you are authorized to access it. This right does not include any right to reproduce, distribute, resell, sublicense or commercially exploit the Service or protected DINAMICA materials except where expressly permitted.

The DINAMICA name, logo, visual identity and other DINAMICA trademarks, service marks, trade names or brand elements are owned by, or used under authority of, DINAMICA. No right to use DINAMICA branding is granted except as expressly authorized or as otherwise permitted by applicable law.

Third-party data, trademarks, content and other materials made available through the Service remain subject to the rights of their respective owners or licensors. Their inclusion in the Service does not transfer those rights to DINAMICA or to you.

User-Provided Information remains subject to the rights described in Section 8. Nothing in this Section transfers ownership to DINAMICA of information or materials that you provide merely because they are stored, processed or displayed through the Service.

You may refer to DINAMICA and to information lawfully obtained through the Service in a manner consistent with these Terms and applicable law, provided that you do not falsely imply sponsorship, endorsement, affiliation or authorization by DINAMICA or materially misrepresent the nature or source of DINAMICA analytical outputs.

If you voluntarily provide suggestions, comments or other feedback concerning the Service (“Feedback”), DINAMICA may use that Feedback to develop, improve and operate the Service without restriction or obligation to compensate you, provided that this does not grant DINAMICA rights in personal data or other materials beyond those otherwise permitted under these Terms, the Privacy Policy and applicable law.

Except where expressly permitted by these Terms or applicable law, no provision of these Terms should be interpreted as granting any license or right to DINAMICA or third-party intellectual property by implication, estoppel or otherwise.

12. Subscriptions, Fees and Payments

DINAMICA may offer the Service through free access, trial access, paid subscriptions or other access arrangements. The features, usage limits, data availability and other conditions associated with each plan may differ and will be described through the Service or at the time the relevant plan is selected.

If you purchase a paid subscription or other paid access to the Service, the applicable price, currency, billing period, taxes where applicable, renewal conditions and other material payment terms will be presented to you before you complete the purchase.

By purchasing a paid subscription, you agree to pay the fees disclosed for the selected plan in accordance with the payment and billing terms presented at the time of purchase.

Where a subscription is offered on an automatically renewing basis, the renewal frequency, renewal price or method by which the renewal price is determined, and the applicable cancellation arrangements will be disclosed before purchase as required by applicable law. Unless you cancel in accordance with the applicable cancellation procedure, an automatically renewing subscription may renew for the period disclosed at the time of purchase.

You may cancel a subscription using the cancellation functionality or other method made available by DINAMICA. Cancellation ordinarily prevents subsequent renewal and does not necessarily terminate access immediately; unless otherwise stated or required by applicable law, access may continue until the end of the subscription period already paid for.

Any right to withdraw from a purchase, receive a refund, terminate a subscription early or obtain another payment remedy will be determined by the conditions applicable to the purchase and by any rights available under applicable law. Nothing in these Terms limits mandatory consumer rights that cannot lawfully be excluded or restricted.

If DINAMICA offers a free or discounted trial, the duration of the trial, functionality included, eligibility requirements and whether the trial converts into a paid subscription will be disclosed when the trial is offered. Where payment will begin automatically following a trial, the applicable price, billing arrangement and cancellation conditions will be disclosed before the user agrees to the trial.

DINAMICA may change subscription prices or the commercial conditions of a plan from time to time. Changes affecting an existing paid subscription will apply in accordance with the notice, renewal and other requirements applicable under the relevant agreement and applicable law. A price change will not retroactively alter fees already paid for a completed billing period.

Payments may be processed by third-party payment service providers. Where a payment provider is used, payment information and transactions may also be subject to that provider's applicable terms and privacy practices. DINAMICA may not receive or store complete payment-card details where those details are processed directly by the payment provider.

If a payment cannot be completed, is declined, reversed or remains unpaid, DINAMICA may take reasonable measures relating to the associated paid access, including requesting an alternative payment method, restricting paid functionality or suspending renewal, subject to applicable law and any applicable payment terms.

Applicable taxes may be included in or added to the displayed price depending on the user's location and applicable tax requirements. The treatment of taxes will be disclosed as required in connection with the relevant purchase.

13. Third-Party Services and Links

The Service may use, integrate with, link to or otherwise interact with services, websites, applications or infrastructure provided by third parties (“Third-Party Services”). These may include, for example, payment processing, authentication, hosting, communications, data services or other functionality used in connection with the Service.

Your use of a Third-Party Service may be subject to separate terms, privacy policies or other conditions established by the relevant third party. Where applicable, you are responsible for reviewing and complying with those conditions when you interact directly with the Third-Party Service.

DINAMICA's use of or integration with a Third-Party Service does not transfer ownership or control of that service to DINAMICA and does not imply that DINAMICA is responsible for all acts, omissions, content, policies or practices of the third-party provider. Similarly, the inclusion of a link to an external website or service does not, by itself, constitute an endorsement by DINAMICA of that website, service, provider or its content.

Third-Party Services may change, become unavailable, restrict functionality or discontinue services independently of DINAMICA. Where a DINAMICA feature depends on a Third-Party Service, such changes may affect the availability or operation of the corresponding DINAMICA functionality.

DINAMICA may modify, replace, restrict or discontinue an integration or other functionality that depends on a Third-Party Service where reasonably necessary because of changes in availability, technical requirements, security considerations, provider arrangements, third-party terms, applicable rights or legal or regulatory requirements.

Where the Service allows you to connect or authorize a Third-Party Service, you are responsible for ensuring that you have the authority to establish that connection and for complying with the conditions applicable to your use of the connected service. DINAMICA will access or use information made available through such a connection only as permitted by the relevant functionality, applicable authorization, these Terms, the Privacy Policy and applicable law.

Third-Party Services may process information independently from DINAMICA in accordance with their own terms and privacy practices. Information about third parties that process personal data in connection with DINAMICA, where applicable, will be provided in the Privacy Policy or other relevant privacy notices.

Nothing in this Section excludes or limits any responsibility that DINAMICA has for the Service under applicable law merely because DINAMICA uses a third-party provider in providing that Service.

14. Service Availability, Changes and Updates

DINAMICA aims to provide reliable access to the Service but does not guarantee that the Service, or every feature or data source within it, will be available continuously or without interruption, delay or error.

The Service may occasionally be unavailable or operate with reduced functionality as a result of scheduled or emergency maintenance, software updates, security measures, infrastructure issues, third-party service interruptions, data-provider availability or other operational circumstances.

DINAMICA may update, develop, modify or replace features, functionality, software, analytical methodologies, data sources, user interfaces or other components of the Service as the platform evolves.

DINAMICA may also restrict, suspend or discontinue particular features, data sources or functionality where reasonably necessary for technical, security, operational, commercial, legal, regulatory, licensing or third-party dependency reasons.

Where a change materially reduces core functionality included in an existing paid subscription, DINAMICA will provide notice or other remedies where required by applicable law or the applicable subscription terms. Nothing in these Terms permits DINAMICA to disregard mandatory rights or remedies available to users in connection with paid digital services.

Updates to analytical methodologies may result in changes to metrics, scores or classifications even where the underlying company, market or analyst information has not changed. Methodology changes and the interpretation of historical analytical outputs are further addressed in Section 7 and the DINAMICA Disclosures.

DINAMICA may perform maintenance, deploy updates or take measures necessary to protect the security, integrity and stability of the Service without prior notice where advance notice is not reasonably practicable. Where appropriate and reasonably practicable, DINAMICA may provide advance information regarding planned interruptions that are expected to materially affect access to the Service.

Features identified as beta, preview, experimental or otherwise under development may be changed, restricted or discontinued and may operate differently from generally available features. Any specific conditions applicable to such functionality may be communicated when the functionality is made available.

The availability, timing and completeness of financial, market and analyst information may depend on third-party data sources and processing schedules. Temporary delays or interruptions in source data may therefore affect the availability or timing of related DINAMICA analytics.

DINAMICA may implement updates or changes necessary to comply with applicable law, regulatory requirements, third-party rights, data-licensing conditions or security requirements. Where such changes affect the Service, DINAMICA will provide information or notice to users to the extent required by applicable law.

Nothing in this Section limits any rights or remedies that cannot lawfully be excluded or restricted under applicable law.

15. Disclaimers of Warranties

The Service provides financial analysis, research, informational and organizational functionality using available financial, market, analyst and other data and DINAMICA's proprietary analytical methodologies.

Financial markets, company information, analyst opinions and other inputs used by the Service may change over time. DINAMICA does not warrant or guarantee that any analytical metric, score, classification, analyst recommendation, analyst price target or other information available through the Service will predict future security prices, investment returns, company performance or other future outcomes.

DINAMICA does not guarantee that an analyst price target will be reached, that a particular analyst view will prove accurate, or that a historical relationship, analytical classification or observed condition will continue or produce a comparable outcome in the future.

DINAMICA takes reasonable measures appropriate to the operation of the Service, but does not warrant that all information available through the Service will at all times be complete, current, uninterrupted or free from errors, omissions or delays. Third-party information may be revised, corrected, delayed, withdrawn or unavailable, and the availability and timing of related DINAMICA analytics may be affected accordingly.

DINAMICA does not warrant that the Service will operate without interruption or that every feature, data source, integration or analytical function will remain available at all times. Service availability and changes are further addressed in Section 14.

To the extent permitted by applicable law, the Service is provided on the basis of the functionality and conditions described in these Terms, the DINAMICA Disclosures and any additional terms applicable to the relevant subscription or feature. Any warranties, guarantees or other statutory rights that cannot lawfully be excluded, restricted or modified remain unaffected.

Nothing in these Terms excludes any obligation expressly undertaken by DINAMICA in relation to a particular paid subscription or other agreement, or any warranty, conformity requirement, consumer right or remedy that applies under mandatory law.

16. Limitation of Liability

The limitations in this Section apply only to the extent permitted by applicable law. Nothing in these Terms excludes or limits liability where, or to the extent that, such liability cannot lawfully be excluded or limited.

To the extent permitted by applicable law, DINAMICA will not be liable for indirect, incidental, special, consequential or similar losses arising out of or relating to the Service or these Terms, including loss of profits, revenue, business opportunity or anticipated savings, where such categories of loss may lawfully be excluded or limited.

DINAMICA is not responsible for investment losses merely because an investment decision was made with reference to information, analytical metrics or classifications available through the Service. This does not exclude liability that DINAMICA may have under applicable law for its own acts or omissions.

To the extent permitted by applicable law, DINAMICA's aggregate liability arising out of or relating to the Service or these Terms will not exceed the total amount paid by you to DINAMICA for the Service during the twelve months immediately preceding the event giving rise to the claim.

Where applicable law requires a different limitation, minimum remedy or measure of damages, the limitation above will apply only to the extent permitted by that law.

The exclusions and limitations in this Section do not apply to liability that cannot lawfully be excluded or limited, including any liability for which exclusion or limitation is prohibited under applicable consumer protection or other mandatory law.

Nothing in this Section limits any refund, price reduction, repair, restoration of conformity, termination right or other remedy that you are entitled to receive under mandatory law or under an express commitment made by DINAMICA in connection with the applicable Service.

17. Indemnification

To the extent permitted by applicable law, if your misuse of the Service, material violation of these Terms, infringement of third-party rights, or unlawful conduct in connection with the Service gives rise to a third-party claim against DINAMICA, you may be responsible for losses, liabilities, damages, costs and reasonable expenses incurred by DINAMICA as a result of that claim, to the extent attributable to your conduct.

This Section does not require you to indemnify DINAMICA for claims, losses or liabilities to the extent caused by DINAMICA's own acts or omissions or by circumstances for which DINAMICA is responsible under applicable law.

DINAMICA will provide reasonable notice of a claim for which it seeks indemnification under this Section and will provide reasonable cooperation in connection with the defense of that claim. DINAMICA will not seek to recover under this Section amounts that result from a settlement imposing obligations on you where you were not given a reasonable opportunity to participate in the defense or consideration of that settlement.

Nothing in this Section limits any rights or protections available to consumers or other users that cannot lawfully be excluded, restricted or transferred under applicable law.

18. Suspension and Termination

You may stop using the Service at any time. You may also cancel a paid subscription in accordance with the cancellation arrangements described in Section 12 and through the functionality or other method made available by DINAMICA.

Cancellation of a paid subscription ordinarily prevents subsequent renewal and does not, by itself, constitute deletion of your DINAMICA account or User-Provided Information. Unless otherwise stated or required by applicable law, access to paid functionality may continue until the end of the subscription period already paid for.

Where the Service permits account deletion, you may request or initiate deletion of your account using the functionality or procedure made available by DINAMICA. Account deletion is distinct from subscription cancellation and may result in loss of access to portfolio records, settings, favorites, saved views and other information associated with your account.

DINAMICA may temporarily restrict or suspend access to all or part of the Service where reasonably necessary to protect the security, integrity or availability of the Service; investigate suspected unauthorized access, fraud or material misuse; address a material violation of these Terms; respond to legal or regulatory requirements; protect third-party rights; or address payment-related issues affecting paid access.

Where reasonably practicable and appropriate in the circumstances, DINAMICA will provide notice of a suspension and information concerning the reason for it. Advance notice may not be provided where immediate action is reasonably necessary for security, fraud prevention, legal or regulatory compliance, protection of users or third parties, or prevention of material harm to the Service.

DINAMICA may terminate an account or the user's right to access the Service where the user materially or repeatedly violates these Terms, engages in unlawful or abusive use of the Service, creates a material security risk, infringes applicable third-party rights, or where continued provision of the Service to that user is prohibited or cannot reasonably be maintained because of applicable legal, regulatory or other mandatory requirements.

Where the circumstances are reasonably capable of being remedied, DINAMICA may provide the user with an opportunity to remedy the relevant violation before terminating the account, unless immediate termination is reasonably necessary because of the nature or severity of the conduct or applicable requirements.

DINAMICA may also discontinue the Service as a whole. Where reasonably practicable, DINAMICA will provide appropriate advance notice of a general discontinuation. Users with an active paid subscription will retain any rights or remedies applicable under the subscription terms or mandatory law in relation to paid access that DINAMICA is no longer able to provide.

Following expiration, suspension or termination of access, certain provisions of these Terms that by their nature are intended to continue may remain applicable, including provisions concerning intellectual property, restrictions on unauthorized use, responsibility for prior conduct and applicable limitations or allocation of liability.

The retention or deletion of personal data and User-Provided Information following account deletion or termination will be handled in accordance with the Privacy Policy, applicable law and any retention obligations or legitimate requirements applicable to DINAMICA.

Nothing in this Section limits any right to cancel, withdraw, terminate, obtain a refund or exercise another remedy that cannot lawfully be excluded or restricted under applicable law.

19. Privacy and Data Protection

DINAMICA processes personal data in connection with the operation and provision of the Service. Information about the categories of personal data processed, the purposes and legal bases of processing, applicable retention practices, recipients or categories of recipients, international data transfers where relevant, and the rights available to individuals is provided in the DINAMICA Privacy Policy and any additional privacy notices applicable to particular functionality.

The Privacy Policy applies to personal data processed by DINAMICA in connection with your account and use of the Service and should be read together with these Terms.

Certain functionality may involve third-party service providers that process personal data in connection with the Service, including providers supporting infrastructure, authentication, communications, payments or other operational functionality. Information concerning relevant recipients, processors or other third parties will be provided in the Privacy Policy or other applicable privacy notices as required.

Where you choose to provide portfolio information, transaction information, preferences, settings or other User-Provided Information that constitutes personal data, DINAMICA will process that information in accordance with the Privacy Policy, these Terms and applicable data protection law.

DINAMICA implements measures intended to protect personal data and the security of the Service appropriate to the nature of the information and the applicable risks. No technical or organizational system can guarantee absolute security, and users remain responsible for taking reasonable measures to protect their account credentials as described in these Terms.

You may exercise applicable privacy and data protection rights through the methods described in the Privacy Policy. Nothing in these Terms limits rights relating to personal data that cannot lawfully be excluded or restricted.

If DINAMICA materially changes how personal data is processed, DINAMICA will update the relevant privacy information and provide any notice, choice or other measure required by applicable law.

20. Changes to These Terms

DINAMICA may update these Terms from time to time to reflect changes to the Service, applicable law or regulatory requirements, commercial arrangements, security requirements, operational practices or other circumstances relevant to the relationship between DINAMICA and its users.

When these Terms are updated, DINAMICA will identify the effective date of the revised Terms and will make the current version available through the Service or the DINAMICA website.

Where a change is material to your rights or obligations, DINAMICA will provide reasonable advance notice through the Service, by email or through another appropriate communication method, except where immediate changes are reasonably necessary to address legal or regulatory requirements, security risks, fraud, abuse or other circumstances in which advance notice is not reasonably practicable.

Any notice of a material change will, where appropriate, describe when the revised Terms will take effect and any action that may be required from you.

Your continued use of the Service after revised Terms become effective may constitute acceptance of the revised Terms where permitted by applicable law and where the nature of the change does not require another form of consent.

Where applicable law requires your express consent to a change, or provides you with a right to terminate, cancel or exercise another remedy as a result of the change, DINAMICA will provide the required consent mechanism, notice or remedy.

Changes to these Terms will not retroactively alter rights or obligations that arose before the effective date of the revised Terms except where expressly agreed, required by applicable law or otherwise legally effective.

The version of these Terms in effect at the relevant time will govern your use of the Service, subject to any rights or obligations that survive under an earlier version or under applicable law.

21. Governing Law and Dispute Resolution

These Terms and your use of the Service are governed by the laws of Sweden, without regard to its conflict-of-laws principles, except to the extent that mandatory provisions of applicable law provide otherwise.

If you are a consumer, the choice of Swedish law does not deprive you of any mandatory protections available to you under the law that would apply in the absence of that choice of law.

If a dispute arises in connection with the Service or these Terms, you and DINAMICA are encouraged to first attempt to resolve the matter directly. You may contact DINAMICA using the contact information provided in Section 23.

If a dispute cannot be resolved directly, it may be brought before the competent courts of Sweden, subject to any mandatory rights you may have to bring proceedings before another competent court under applicable law.

Nothing in this Section prevents either party from seeking urgent or interim judicial relief where such relief is available and appropriate under applicable law.

Nothing in these Terms requires a consumer to waive access to a court, statutory consumer protection, mandatory dispute-resolution rights or other remedies that cannot lawfully be excluded or restricted.

22. General Provisions

These Terms, together with the Privacy Policy, the DINAMICA Disclosures and any additional terms expressly made applicable to a particular feature, subscription or service, constitute the terms governing your use of the Service with respect to the matters they address.

If any provision of these Terms is found to be invalid, unlawful or unenforceable, that provision will be interpreted or limited to the extent necessary to make it enforceable where permitted by applicable law. If it cannot be made enforceable, it will be treated as severed from these Terms, and the remaining provisions will remain in effect to the extent permitted by applicable law.

If DINAMICA does not exercise or enforce a right or provision under these Terms on a particular occasion, this does not constitute a waiver of that right or provision or prevent DINAMICA from exercising or enforcing it subsequently.

You may not assign or transfer your account or your rights or obligations under these Terms to another person without DINAMICA's prior consent, except where applicable law provides otherwise.

DINAMICA may transfer its rights or obligations under these Terms in connection with a merger, corporate reorganization, financing, acquisition, sale of business or assets, or other transfer of the Service or the business operating it, subject to applicable law and provided that such transfer does not reduce rights that cannot lawfully be restricted. Where notice or consent is required by applicable law, DINAMICA will provide or obtain it as required.

Nothing in these Terms creates a partnership, joint venture, employment, agency, fiduciary or similar relationship between you and DINAMICA merely as a result of your use of the Service.

Section headings are provided for convenience and organization and do not independently determine the interpretation of these Terms.

Provisions that by their nature are intended to continue after termination or expiration of your access to the Service will remain effective to the extent necessary to give effect to their purpose and as permitted by applicable law.

If there is a conflict between these Terms and additional terms expressly applicable to a particular feature or service, the additional terms will control with respect to that feature or service to the extent of the conflict. Mandatory provisions of applicable law will prevail where they cannot lawfully be modified by agreement.
